Blue v. Kawasaki Motors USA

The Firm has a stellar track record of defending companies threatened by the current wave of product liability class action suits being filed in plaintiff-friendly courts around the country. These cases require knowledgeable, experienced, highly coordinated representation. One of the preferred strategies for defending against these actions is to successfully oppose their certification for class action. The following case illustrates an example of the Firm’s Product Liability practice group defending such a case

Blue v. Kawasaki Motors Corp. USA. This suit was filed in Johnson City, Texas, a nationally-known class action venue. The judge handling the case had ruled upon almost all of the other class action cases filed in that venue and he never failed to certify a class action within the last 10 years. Thompson Coburn represented Kawasaki in the case. The discovery in this case was very broad and lasted for almost two years. A certification hearing was held which lasted almost two weeks. During the hearing, both sides presented expert testimony, including legal experts, economists, engineers, amongst others. Just before the closing arguments in the hearing, the plaintiff’s counsel dismissed the action.
